The purpose of these general conditions of sale is, on the one hand, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties in connection with the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales on the Douces Angevines website.

Les Douces Angevines reserves the right to modify these general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Acceptance of the general conditions of sale

Any order of a product offered on the Douces Angevines online store implies consultation and express acceptance of these general conditions of sale, without however this acceptance being conditioned by a handwritten signature on the part of the buyer. In accordance with the provisions of articles 1316 to 1316-4 of the civil code, supplemented by decree n° 2001-272 of March 30, 2001, taken for the application of article 1316-4 of the civil code and relating to the electronic signature, it is recalled that the validation of the order form constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

Order and sale price

The sale prices of products online on the site are indicated in euros, and are those in force at the time of registration of the order form by the Buyer.

Ils ne comprennent pas les frais d’expédition, facturés en supplément du prix des produits achetés suivant le montant de la commande. Les frais d’expédition seront indiqués avant l’enregistrement de la commande par l’Acheteur. Les frais d’expédition sont calculés sur le prix final payé par l’acheteur, ils sont donc recalculés après remise lorsque l’acheteur bénéficie d’une remise sur ses achats.

The prices include the value added tax (VAT) applicable on the day of the order and any change in the applicable rate will be automatically passed on to the price of the products sold.

For Switzerland, invoicing will be exclusive of tax. At the time of confirmation of the country of delivery, the amount invoiced will be announced excluding VAT. On the other hand, the Buyer will be liable for Swiss customs taxes upon receipt of his package.

If the selling prices of the products were to be modified by Les Douces Angevines, the modification would be notified to the Buyer before any order is placed.

The buyer is informed and accepts that the entry of any identifier is proof of his identity and expresses his consent.

Once identified, an order form will appear on the screen, summarizing the details of the order: the nature, quantity and price of the Products retained by the Buyer, as well as the total amount of the order, the contact details of the Buyer , the delivery address of the Products.

The sale will only be considered final after the order confirmation has been sent to the Buyer and the full price has been collected.

Les Douces Angevines recommends that the Buyer keep this information in a paper or electronic document.

Any fraudulent order or presumed as such, will be considered by Les Douces Angevines as null and void.

Payment

Payment must be made when ordering by the Buyer. At no time can the sums paid be considered as a deposit or down payment.

All orders are payable in euros. The Buyer guarantees Les Douces Angevines that he has the necessary authorizations to use the method of payment he has chosen, when registering the order form.

Les Douces Angevines reserve the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any amount due by the Buyer, in the event of payment incident or in the event of an existing dispute with the Purchaser.

For any payment, Les Douces Angevines reserves the right to request a photocopy of the Buyer's identity card and, where applicable, that of the holder of the means of payment used by the Buyer. For amounts over 400 euros including tax, Les Douces Angevines reserves the right to request a certified photocopy of an identity document.

As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.

To pay for his order, the Buyer has the following payment methods: credit card, bank or postal check issued by a French bank, transfer, PayPal.

  • The bank cards accepted on the site are as follows: Carte Bleue, Visa and Master Card.
  • Bank or postal checks issued by a French bank: In the event of payment by check, the Purchaser will make out his check to the order of Douces Angevines. He will specify his order number on the back of the check. He will send this check by post to the following address: Les Douces Angevines – 4 Venelle Tire-Jarret – La Roche Foulques – 49140 Soucelles. Only checks issued by a French bank are accepted. The cancellation of the order before sending the check is possible by simply sending an e-mail to contact@lesdoucesangevines.com specifying the order number.

Shipping terms and rates

Le franco de port est accordé pour toutes commandes livrées en France Métropolitaine d’un montant supérieur ou égal à 69€ TTC (il s’agit bien du montant effectif réglé, donc du montant après remise le cas échéant). Sinon des frais d’envoi seront demandés selon la zone d’expédition (see price details here)

The products will be delivered at your choice to a colissimo relay point, or by colissimo with signature to the address indicated by the Buyer on the order form, destination which must be consistent with the geographical area previously agreed.

By default, invoices are sent to the e-mail address indicated by the Customer when registering. Failure to comply with the procedures set out below, no claim from the Buyer will be accepted.

Receipt of goods

All our shipments are tracked by the Post Office (colissimo with signature or delivery to a relay point). The customer is invited to check the status of the shipments and their compliance with the order form. In the event that the Buyer has any doubt whatsoever about the condition or content of his package, he is required to: - Apply the Colissimo procedure (in particular report the damage due, any complaints and reservations ) and to refuse the goods by immediately issuing a report of anomaly to the Post Office employee (report 170) or to the nearest post office within 48 hours of receipt of the package. -To report these incidents within 48 hours to Douces Angevines at contact@lesdoucesangevines.com specifying the order number.

Legal guarantees

In accordance with the regulations in force, our products benefit from:

  • the legal guarantee of conformity (Articles L211-4 to L211-13 of the consumer code), for products that are apparently defective, damaged or damaged, or that do not correspond to the order. According to article L211-7 of the consumer code, defects of conformity which appear within 24 months from the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise. The seller can challenge this presumption if it is not compatible with the nature of the goods or the lack of conformity invoked. The buyer can choose between repairing or replacing the product (however, the seller may not proceed according to the buyer's choice if this choice entails a manifestly disproportionate cost with regard to the other modality).
  • the legal guarantee against hidden defects (Articles 1641 and following of the Civil Code), resulting from a defect in material, design or manufacture affecting the products delivered and rendering them unsuitable for the use normally intended. The buyer can then choose between the resolution of the sale: return of the product (at the expense of the buyer) and full refund of the price of the product by the seller, or a reduction of the sale price, in accordance with article 1644 of the civil Code.

Any dispute relating to the conformity of the products in relation to the order or to a hidden defect must be notified in writing to Douces angeviens – 4 Venelle Tir Jarret – La Roche Foulques – 49140 Rives-du-Loir-en-Anjou, accompanied by the voucher corresponding delivery date within a reasonable time following receipt of the products.

Withdrawal / Return of one or more products

The customer has a period of fourteen clear days from receipt of the order to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs. When the fourteen-day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day. Only returned products will be taken back, in their original packaging, unopened, complete and intact, in perfect condition for resale and not consumed.

To return an item, the buyer must first contact Douces Angevines to obtain a return number. He can do so by email to compta@lesdoucesangevines.com specifying the invoice number and the reference of the item(s) concerned as mentioned on the invoice, as well as the reason for the return. He can also do this by using the withdrawal form received by email at the same time as the invoice for his order (the form is also available here).

Once the return number has been obtained, the buyer will send the package concerned to the following address: Douces Angevines / 4 Venelle Tir Jarret / La Roche Foulques / 49140 Soucelles. Les Douces Angevines will not accept any return package if it is not accompanied by a return number and will not accept packages sent postage due either. Failure to comply with the procedure set out above and the deadlines indicated above, the buyer may not make any claim for non-compliance or apparent defect of the products delivered, the products then being deemed to be compliant and free from any apparent defect.

The customer will be reimbursed for all sums paid, as soon as possible and at the latest within fourteen days following the date on which he exercised his right of withdrawal. Beyond that, the sum due is, as of right, productive of interest at the legal rates in force. This repayment is made by any means of payment. On the proposal of Les Douces Angevines, the customer who has exercised his right of withdrawal may however opt for another method of reimbursement.

The return of a product that has been paid for with a credit note or gift voucher will result in a new credit note or gift voucher and not a refund.

The costs and risks of returning the goods to the headquarters of LES DOUCES ANGEVINES, 4 Venelle Tir Jarret, La Roche Foulques – 49140 SOUCELLES, are the sole responsibility of the customer. Any product that has been damaged, or whose original packaging has been damaged, or partially consumed, will not be refunded or exchanged.

Retention of title

Law n°80335 of May 12, 1980: the goods remain the property of Douces Angevines, until full payment.

Storage of products

All our products carry a 12M (12 months after opening) or 6M (6 months after opening) label in order to delimit the date of consumption or use. Our products must be stored in a dry place, away from light, without excessive temperature differences.

Protection of personal data

In order to process orders, Douces Angevines processes personal data concerning the customer, identified as “mandatory information” in the form on the website. Douces angevines is committed to respecting the confidentiality of personal data provided by customers.

The customer's personal data will not be communicated to third parties, except in response to an order from the judicial or administrative authorities.

When creating or consulting his account on the website, the customer will choose whether he wishes to receive news, commercial or promotional offers from Douces Angevines by newsletter. If the customer no longer wishes to receive these offers, he can request it at any time by clicking on an electronic link available on each newsletter, or by modifying his account directly on the website www.doucesangevines.com (by going to "My account")

The customer can exercise his individual right of access to the file, his right of opposition, rectification or deletion for the data concerning him at any time, either by modifying his personal information himself by going to his account on the site www.doucesangevines.com, or by sending a request to Douces Angevines by post to the following address: Douces Angevines – 4 Venelle Tir Jarret – La Roche Foulques – 49140 Soucelles, indicating surname, first name, postal address and email.

In compliance with the provisions set out in article L223-2 of the Consumer Code*, the customer is informed of the fact that he has the right to register on the list of opposition to canvassing by going to the following address: “https://conso.bloctel.fr”, section “you are a consumer”. The customer must then follow the registration procedure allowing him to oppose telephone canvassing. (* “When a professional is required to collect telephone data from a consumer, he informs him of his right to register on the opposition to canvassing campaign”.

The customer can terminate his registration on the site www.doucesangevines.com at any time and close his account. The customer will send his request for termination to contact@lesdoucesangevines.com. In the event of the customer's breach of one of his contractual obligations, in particular in the event of a payment incident, Douces Angevines reserves the right to suspend the customer's access to the website, or even to terminate his account depending on the degree seriousness of the breaches. Douces Angevines reserves the right to refuse any order from a customer with whom there is a dispute.

Applicable law and attribution of jurisdiction

French law is the only applicable.
